Terms of Service

These Terms of Service (“Terms”) govern the use of services provided by E4 Digital Marketing (“Company,” “we,” “us,” or “our”). By booking, purchasing, or using our photography, videography, and/or event rental services, you (“Client,” “you,” or “your”) agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our services.

1. Services Offered

E4 Digital Marketing provides professional services including, but not limited to:

Photography services
Videography services
Editing and post-production
Event rentals, including equipment, props, décor, or related items

Specific details regarding services, pricing, deliverables, and timelines will be outlined in a separate agreement, invoice, or booking confirmation.

2. Booking and Payments

2.1 Reservations

All bookings are confirmed only after receipt of any required deposit, payment, and/or written confirmation.

2.2 Payments

Payment terms are provided at the time of booking.
Deposits are non-refundable unless otherwise stated in writing.
Full payment is due prior to or on the date of service unless otherwise agreed.

2.3 Late Payments

Failure to submit payment on time may result in delayed delivery of final products, cancellation of services, or additional fees.

3. Cancellations and Rescheduling

3.1 Client Cancellations

All cancellations must be made in writing.
Deposits are non-refundable.
Cancellations made within [X] days of the scheduled service may require full payment.

3.2 Rescheduling

Rescheduling requests are subject to availability and must be made in writing. Additional fees may apply.

3.3 Company Cancellations

If E4 Digital Marketing is unable to perform services due to illness, emergency, or circumstances beyond our control, we will make reasonable efforts to reschedule. If rescheduling is not possible, liability is limited to a refund of payments made, excluding non-recoverable expenses.

4. Photography & Videography Services

4.1 Creative Style

The Client acknowledges familiarity with E4 Digital Marketing’s style and agrees that creative discretion and judgment remain with the Company.

4.2 Deliverables

Delivery timelines are estimates and not guaranteed.
Raw or unedited files are not provided unless explicitly agreed upon in writing.

4.3 Revisions

Included edits are limited to those agreed upon in advance. Additional revisions may be subject to additional fees.

5. Event Rentals

5.1 Rental Period

Rental items are provided for the agreed-upon duration only. Late returns may result in additional charges.

5.2 Responsibility for Rental Items

The Client assumes full responsibility for all rental items from the time of pickup or delivery until returned.

Lost, stolen, or damaged items beyond normal wear and tear will be billed at repair or replacement cost.

5.3 Proper Use

Rental items must be used only for their intended purpose and in a safe and lawful manner.

6. Intellectual Property & Usage Rights

6.1 Ownership

All photographs, video footage, and related content remain the intellectual property of E4 Digital Marketing unless otherwise agreed in writing.

6.2 Client License

Clients are granted a non-exclusive, non-transferable license to use delivered content for personal use or approved commercial purposes.

6.3 Promotional Use

E4 Digital Marketing reserves the right to use images and videos for portfolio, website, social media, advertising, and promotional purposes unless the Client submits a written request opting out prior to service delivery.

7. Client Responsibilities

The Client agrees to:

Secure any necessary permissions or permits for locations
Ensure cooperation of event attendees or participants
Notify E4 Digital Marketing of any venue rules, restrictions, or special requirements in advance

The Company is not responsible for missed or limited coverage due to lack of cooperation, venue restrictions, weather conditions, or circumstances beyond its control.

9. Limitation of Liability

To the fullest extent permitted under Michigan law:

Liability is limited to the total amount paid for services.
E4 Digital Marketing shall not be liable for indirect, incidental, special, or consequential damages.
The Company is not responsible for service interruptions caused by equipment failure, acts of nature, government restrictions, or other events beyond reasonable control.

10. Indemnification

The Client agrees to indemnify and hold harmless E4 Digital Marketing from any claims, damages, losses, or expenses arising from:

Client negligence or misconduct
Misuse of rental equipment
Violation of these Terms

11. Force Majeure

E4 Digital Marketing shall not be liable for failure or delay in performance due to causes beyond reasonable control, including but not limited to natural disasters, acts of God, government orders, power outages, or labor disruptions.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles.

13. Modifications

E4 Digital Marketing reserves the right to update or modify these Terms at any time. Changes become effective immediately upon posting.
